Trump's new attorney Rudy Giuliani claims Trump said "don't pay with cash", sticking with his previous claims that Trump wanted everything on paper.

Trump is right. It wasn't illegal or necessarily improper for Cohen to tape a conversation with his client, but to release that tape to CNN was a shocking violation of his duty to preserve client confidences under the New York Lawyer's Code of Professional Responsibility, DR 4-101. But it would be a harder case to make if the payment was seen as merely created to protect Trump, who is married, from embarrassment in his personal or private life.

During an interview on Fox News, Napolitano explained why the secretly recorded tape could be concerning for Trump and his associates.

If he winds up in investigators' crosshairs for secreting payoffs, he could potentially provide much more damaging information to prosecutors than Cohen ever could about the president's dealmaking.

"This is about truth versus lying and ultimately Trump is going to be done in by the truth".
