Deputy Chief Justice Raymond Zondo has upheld an earlier high court judgment.

As to how a police officer would know whether the amount of cannabis in the possession of an adult is or is not for that adult person's personal consumption, the Court held that a police officer would have to consider all the circumstances - including the quantity of cannabis found in an adult person's possession.

Rastafarian Garreth Prince and former Dagga Party leader Jeremy Acton brought the case asking the High Court to allow for the home use of marijuana. But several government ministries - the justice, police, health and trade - challenged the ruling.

The judgement did not say how much cannabis one may have at home for private use.

South Africa joins Zimbabwe which in April became the second country in Africa, after Lesotho, to legalise the use of marijuana for medical use.

The judgement repeatedly states that the ruling only applies to private use of marijuana, ruling out public consumption of the drug.

The growing of the drug has also been legalised as long as it is being produced for private use.

"We have used cannabis to treat anxiety, colic in children and as an antiseptic in secret for many years", said Phephsile Maseko, of the Traditional Healers Organisation.

Tuesday's ruling follows a judgment that the possession, cultivation and use of dagga for private use was allowed.

It suspended its order of invalidity for a period of 24 months to give Parliament an opportunity to correct the constitutional defects in the two acts.

Coca-Cola Company on Monday indicated that it was eyeing weed-infused drinks to expand its products list and increase market share.

Jules Stobbs and Myrtle Clarke‚ known as the "Dagga Couple", joined the case, and asked the court to strike down laws banning the use‚ cultivation and sale of marijuana.
