USA blasts worldwide court on Iran ruling, pulls out of 1955 treaty

US ordered to lift sanctions on 'humanitarian' goods

It also said the reasons cited by President Trump for re-imposing the sanctions were unfounded because the International Atomic Energy Agency (IAEA) had repeatedly confirmed that Iran was complying with the terms of the 2015 nuclear accord signed by Tehran and six world powers.

In a symbolic victory for Tehran's campaign to isolate Washington from the worldwide community, the global Court of Justice (ICJ) ordered Mr Trump's administration to lift sanctions on humanitarian supplies and aviation equipment entering Iran.

Announcing the decision, the court's president, Judge Abdulqawi Ahmed Yusuf, said USA sanctions on goods "required for humanitarian needs.may have a serious detrimental impact on the health and lives of individuals on the territory of Iran".

U.S. sanctions also had the "potential to endanger civil aviation safety in Iran and the lives of its users".

Despite worldwide criticism, Washington is pushing ahead with the measures.

The unilateral US move has been opposed by the other countries that are party to the agreement, including Washington's close European allies Britain, France and Germany as well as Russian Federation and China. Pompeo called Tehran's case before the court "meritless" and accused Iran of abusing the ICJ for political purposes.

US State Department Legal Adviser Jennifer Newstead had last said that Iran's real problem was its frustration over US' plans to pull out of the 2015 nuclear pact.

While imposing the so-called "provisional measures", the court's president, Abdulqawi Ahmed Yusuf, stressed that the case will continue and the United States could still challenge the court's jurisdiction.

Iranian Foreign Minister Mohammed Javad Zarif hailed the ruling as "another failure for the sanctions-addicted USA government and a victory for the rule of law".

U.S. lawyers argued that the ICJ should not have jurisdiction and that Iran's assertions fell outside the bounds of the treaty.

"As you can see, Article 1 on the Treaty-'There shall be firm and enduring peace and honest friendship between the United States of America and Iran'-hasn't aged very well over the years", remarked Foreign Policy reporter Robbie Gramer.

"The United States has been actively engaged on these issues without regard to any proceeding before the ICJ".

In 1986, Washington disregarded the court´s finding that it had violated worldwide law by supporting the pro-US Contra the ICJ´s ruling rebels in Nicaragua. It had argued that US sanctions, which were lifted when the agreement was implemented in 2016, violated the 1955 Treaty of Amity.

Rulings by the ICJ are binding and can not be appealed, but it has no way to enforce its decisions.

"The court´s ruling today was a defeat for Iran".

Limiting food and medical products "may have a serious detrimental impact on the health and lives of individuals on the territory of Iran", the court said. "He said it was imperative for other countries 'to collectively counter malign USA unilateralism" and he accused the U.S. of being an "outlaw regime". But both nations have in the past ignored the court's rulings.

Trump and Iranian President Hassan Rouhani faced off at the United Nations in September, with Rouhani denouncing leaders with "xenophobic tendencies resembling a Nazi disposition".

The sanctions have caused Iran's economy and currency to decline sharply, and a new round of penalties to limit oil exports take effect in November.

What remains unclear is the extent to which the goal of the Trump administration is to force Iran back to the negotiating table - or to go further and push for regime change in Tehran.
