The court's order directed each party in the case to file briefs by Nov. 19 outlining, "what, if any effect, the November 7, 2018 designation of an Acting Attorney General different from the official who appointed Special Counsel Mueller has on this case".

Without Sessions' campaign or Russian Federation entanglements, there's no legal reason Whitaker couldn't immediately oversee the probe.

Those include an op-ed in which he said Mueller would be straying outside his mandate if he investigated Trump family finances and a talk radio interview in which he maintained that there was no evidence of collusion between the Kremlin and the Trump campaign. And since Sessions technically resigned instead of forcing the White House to fire him, he opened the door under federal law to allowing the president to choose his successor instead of simply elevating Rosenstein, said University of Texas law professor Stephen Vladeck. But Mueller's post, special counsel, doesn't require Senate confirmation.

Whitaker, on the other hand, has no intention of recusing himself, according to people close to him. Now, the task has fallen to Whitaker, and Democrats are demanding that he, too, should recuse himself because of his past criticism of the Mueller investigation.
