The Trump administration's efforts to repeal much of the health care law failed in the Senate in 2017 when the late Senator John McCain gave a thumbs down vote.

U.S. District Judge John D. Bates blocked a rule that was finalized a year ago that allows small businesses and self-employed people to band together to purchase insurance known as association health plans. At the urging of the White House, the Justice Department said this past week it will support the Texas judge's position and argue that all of "Obamacare" must go.

Health care - and Trump's attempts to roll back Obamacare - became a galvanizing issue for Democrats in the 2018 midterms.

The lawsuit alleged the primary objective of the Association Health Plan rule was to undermine the Affordable Care Act without accounting for increased risk of fraud and harm to consumers.

There's no sign that his administration has a comprehensive health care plan, and there doesn't seem to be a consensus among Republicans in Congress. "No", said economist Gail Wilensky, who headed up Medicare under former Republican President George H.W. Bush.

New York, 10 other states and the District of Columbia filed a lawsuit challenging the Association Health Plan rule.

Bates' ruling comes after an intense week in the courts for the administration's health care policies. Bates said he agreed with states challenging the rule that the Department of Labor stretched the definition of the "employer". Mulvaney told ABC News that "debate about pre-existing conditions is over".
